Definitions
"Applications" and/or "Content" refer to any file, device or software that can be downloaded by you to either a computer or a wireless device such as a handset or a personal digital assistant.
"Kohl’s Mobile Sale Alerts" is a recurring service where text messages (including, but not limited to, RCS (Rich Communication Services), SMS (Short Message Service) and MMS (Multimedia Message Service) messages) are sent by Kohl’s via an autodialer to your mobile device. These text messages may contain, among other things, mobile alerts relating to Kohl’s marketing and promotional events, order and product information, and abandoned cart reminders. The maximum number of messages you will receive per month will vary based on the program that you have enrolled in.
"Service" means the Kohl's Mobile Sale Alerts and any associated abbreviated dial code, Applications or Content.
"We," "our," "us" and "provider" refer to Kohl's, Inc. and its subsidiaries and affiliates ("Kohl's"), as well as any other person or entity providing any service, applications or content to you from us or on our behalf.
"You" means the person or entity who signs up to participate in, or uses in any way, Kohl's Mobile Sale Alerts.
Acceptance by You
You must be 18 years or older in order to participate or have the express permission of a parent/guardian (but in any case, you must be at least 13 years old). By affirmatively signing-up for Kohl’s text messages and otherwise using the Service provided by us, you have expressly agreed to be bound by the terms and conditions herein ("Agreement") and you are consenting to receive Kohl’s text message disclosures ("Disclosures") electronically. If you do not consent to the terms of this Agreement and do not agree to receive electronic Disclosures, you must immediately cease using the Services that you have received and contact us as provided below. Your consent to this Agreement includes authorization for Kohl’s to deliver advertising messages using an autodialer; and you acknowledge that your consent to this Agreement is not in any way required as a condition of making purchases at Kohl’s stores or Kohls.com.
You should print or store a copy of this Agreement for your records, as well as any Disclosure that is important to you. In order to do so, you must have a SSL-enabled web browser and capability to print or store Disclosures.
Content You May Receive
Once you affirm your choice to opt-in to the Service, your message frequency will vary based on the program that you have enrolled in. You may receive Kohl’s Mobile Sale Alerts about topics including, but not limited to:
- Enrollment and welcome messaging
- Order and shipping information
- Abandoned cart/browsing reminders
- Marketing/promotional messaging, offers, and coupons
- Store and product information
- Surveys, contests/giveaways, and interactive messaging
- Kohl's Cash and Rewards enrollment, reminders, and updates
MMS Disclosure
The Service may send SMS messages if your mobile device does not support MMS messaging.
Supported Carriers
The Service is available on most major carriers within the United States but supported carriers may change from time to time. Carriers are not liable for delayed or undelivered messages. Not all mobile devices may be supported and text messaging may not be available in all areas.
Duty to Notify and Indemnify
If at any time, you intend to stop using the mobile telephone number that you have used to enroll in Kohl’s Mobile Sales Alerts, including but not limited to, canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the opt out process prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these Terms. You further agree to indemnify, defend, and hold us harmless for all claims, expenses, and damages (including attorneys’ fees) related to or caused, in whole or in part, by your failure to complete the opt out process if you change, transfer, or intend to stop using your telephone number including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
Is it free?
Although Kohl’s does not charge you for sending or receiving text messages, you may be charged by your carrier depending upon your text plan.
What if I don't want to receive Kohl’s Mobile Sale Alerts anymore?
To stop receiving Kohl’s Mobile Sale Alerts, simply reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, and/or UNSUBSCRIBE. After doing so, you will receive confirmation of your opt-out, and thereafter, you will no longer receive Kohl’s Mobile Sale Alerts from Kohl’s.
What if I want to opt back in to Kohl’s Mobile Sales Alerts?
You can start receiving Kohl's Mobile Sale Alerts again by signing up as you did the first time and we will start sending Kohl’s Mobile Sale Alerts to you once again.
