Please read these Kohl’s SMS Alerts Terms & Conditions (these “Terms”) carefully. These Terms govern Kohl’s Mobile Sale Alerts and Kohl’s One-Time Alerts. By enrolling in Kohl’s Mobile Sale Alerts or requesting a Kohl’s One-Time Alert, you agree to these Terms, as well as Kohl’s Privacy Policy and Kohl's Legal Notices, which include an ARBITRATION AGREEMENT, JURY TRIAL WAIVER, AND A CLASS ACTION WAIVER that affect your rights and govern how claims you and we have against each other are resolved. The maximum number of text messages you will receive per month will vary based on the program that you have enrolled in. In the event you have enrolled in multiple programs, the most recent Terms shall apply and will supersede any prior versions thereof. Definitions
“Kohl’s One-Time Alerts” is a one-time message service where a single text message, which may be a RCS (Rich Communication Services), SMS (Short Message Service), or MMS (Multimedia Message Service) message, is sent by Kohl’s via an autodialer to your mobile device in response to your request. Kohl’s One-Time Alerts may contain a link to a digital Kohl’s coupon or other requested information or offer. Kohl’s One-Time Alerts are separate from Kohl’s Mobile Sale Alerts and do not enroll you in Kohl’s Mobile Sale Alerts or any other recurring text-message program.
"Kohl’s Mobile Sale Alerts" is a recurring messaging service where text messages (including, but not limited to, RCS, SMS, and MMS messages) are sent by Kohl’s via an autodialer to your mobile device. By enrolling in Kohl’s Mobile Sale Alerts, you consent to receive recurring automated marketing text messages from Kohl’s at the mobile number you provide. These text messages may contain, among other things, mobile alerts relating to Kohl’s marketing and promotional events, order and product information, and abandoned cart reminders. The maximum number of messages you will receive per month will vary based on the program that you have enrolled in.
"Service" means the Kohl’s Mobile Sale Alerts and, as applicable, Kohl’s One-Time Alerts.
"We," "our," "us" and "provider" refer to Kohl's, Inc. and its subsidiaries and affiliates ("Kohl's"), as well as any other person or entity providing any service, applications or content to you from us or on our behalf.
"You" means the person or entity who signs up to participate in Kohl’s Mobile Sale Alerts, requests a message through Kohl’s One-Time Alerts, or otherwise uses the Service.
Content You May Receive
Once you affirmatively opt in to Kohl’s Mobile Sale Alerts, your message frequency will vary based on the program in which you enrolled. You may receive Kohl’s Mobile Sale Alerts about topics including, but not limited to:
- Enrollment and welcome messaging
- Order and shipping information
- Abandoned cart/browsing reminders
- Marketing/promotional messaging, offers, and coupons
- Store and product information
- Surveys, contests/giveaways, and interactive messaging
- Kohl's Cash and Rewards enrollment, reminders, and updates
MMS Disclosure
The Service may send SMS messages if your mobile device does not support MMS messaging.
Supported Carriers
The Service is available on most major carriers within the United States but supported carriers may change from time to time. Carriers are not liable for delayed or undelivered messages. Not all mobile devices may be supported and text messaging may not be available in all areas.
Duty to Notify and Indemnify
If at any time, you intend to stop using the mobile telephone number that you have used to enroll in Kohl’s Mobile Sale Alerts, including but not limited to, canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the opt out process prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these Terms. You further agree to indemnify, defend, and hold us harmless for all claims, expenses, and damages (including attorneys’ fees) related to or caused, in whole or in part, by your failure to complete the opt out process if you change, transfer, or intend to stop using your telephone number including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
Is it free?
Although Kohl’s does not charge you for sending or receiving text messages, you may be charged by your carrier depending upon your text plan.
How do I opt out of Kohl’s marketing text-message programs?
To stop receiving messages from a Kohl’s marketing text-message program, including Kohl’s Mobile Sale Alerts and Kohl’s One-Time Alerts, reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. If you are enrolled in multiple Kohl’s text-message programs, you must opt out of each program separately. After doing so, you will receive confirmation of your opt-out and will no longer receive messages from that program.
What if I want to opt back in to Kohl’s Mobile Sale Alerts?
You can start receiving Kohl's Mobile Sale Alerts again by signing up as you did the first time and we will start sending Kohl’s Mobile Sale Alerts to you once again.
